Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") govern your use of the Momo mobile application and related services (the "App"), published by Selcora Mobile ("we", "us" or "our"). By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. License

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the App for its intended purpose, practicing everyday words at home, on Apple devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service.

3. Using Momo with your child

The App is designed for parents and caregivers to use together with their child. You are responsible for supervising your child's use of the App and of your device, including any purchases made on it.

4. Your content

The App lets you create a child profile with a name and an avatar, and it records practice history ("Your Content"). You keep all rights to Your Content. Because Your Content is stored on your device, you are responsible for it. You agree not to add content that is unlawful or that infringes the rights of others.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile or attempt to extract the source code of the App, except where the law permits it
• Use the App for any unlawful, harmful or fraudulent purpose
• Interfere with or disrupt the App or the third-party services it relies on
• Resell, sublicense or commercially exploit the App or its content without our written permission

6. Free features and subscriptions

The App is free to download, and some word packs are free to use. Momo Premium unlocks every word pack and removes ads through auto-renewing monthly or yearly subscriptions purchased in the App through the Apple App Store. Prices are shown in the App before you buy.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store account settings.
• Eligible users may be offered a free trial or an introductory price. Any unused portion of a free trial ends when you buy a subscription, where applicable.

7. Refunds

All purchases are processed by Apple, and refund decisions are made solely by Apple in accordance with its policies. By making a purchase and subsequently requesting a refund through Apple, you acknowledge and agree that we may provide Apple with information about your purchase and app usage activity, as described in our Privacy Policy, to assist Apple in evaluating your refund request.

8. Practice aid, not a medical device

Momo is an educational practice aid. It is not a medical device, and it is not a substitute for professional medical, clinical or therapeutic advice, diagnosis or treatment, including the care of a licensed speech-language pathologist. Speech recognition may not recognize every word, voice or accent. Always seek the guidance of a qualified professional about your child's speech, language or development.

9. Intellectual property

The App, including its software, design, text, word lists, illustrations, sounds and the Momo name, mascot and logo, is owned by Selcora Mobile and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10. Third-party services

The App uses third-party services, such as Apple, Google Firebase, Google AdMob, OneSignal and Hece, as described in our Privacy Policy. Your use of those services may also be subject to their own terms.

11. Apple

These Terms are between you and Selcora Mobile, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Disclaimer of warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy or uninterrupted operation. We do not warrant that the App will be error-free or that speech recognition or voices will be accurate in every case.

13. Limitation of liability

To the maximum extent permitted by law, Selcora Mobile is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or related to your use of, or inability to use, the App.

14. Termination

We may suspend or end your access to the App if you violate these Terms. You may stop using the App at any time by deleting it.

15. Changes to these terms

We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the revised Terms. We will update the "Last updated" date above.

16. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law provisions, unless mandatory consumer protection laws where you live require otherwise.
